Friend bought a 98 sportster from a Harley dealer in town.

He is unable to let the bike idle anymore (it dies), or can't even reach over 2500rpms. It's been 28 days, and he has until 30 days to return it or do half price repairs. The dealership will not see his bike (they say too busy), until Friday aka after their purchase period. This just seems so shady to me. **** the 1st day he bought it, the front brake was grabbing and the back brake was acting up. He took it in and they forced him to pay half price for repairs on it not more than 3 hours after he purchased.

Something doesn’t sound on the up and up with this dealership. If I was your friend I’d march through the front doors today and demand the owner or manager...I’d tell him I’m returning the bike within the 30 day period due to the issues you mentioned.

YEP this is what he needs to do. This all thing really smells bad. Just return the bike and buy a new one (not from the same dealer for sure)

From what I gather, returning it is only an option for half the purchase price (already paid off).

Most definately would just return it today and if they want to keep the Sale they will fix everything for him for free or take the bike back and fix it before they resale again, either way I think once they realize they are going to be stuck with the repairs they will probably just fix it but at that point I probably would not even take the bike, Just turn it in and be done with the headache. Then do your friend a solid and take him by the Yami dealer to get a bike that will not have these issues.

so what you're saying is they give him 30 days to return the bike but they'll only give him half his money back?!? As soon as i heard some absurd thing like that come out of the salesman's mouth while telling me about their return policies I would've walked out.

Actually most states have laws on this as well. Definitely have him take the bike back, get full money back, and then go by a Stryker.

Most states have a lemon law. I had a problem with a car before and I had to make a appointment, make records of every phone call and appointment and save all receipts. Regardless of when the warranty is up the appointment would be made verbally before it had expired. A court would see to your friends side before the dealer due to the amount of repairs. I would go right down there and return the bike if they don't fix it within resonable time. If they refuse I would take them to court for the price fo the bike the repairs and my time.

As I found out when I bought a used Toyota Matrix with a bum transmission from a shady dealer: Lemon laws only apply to new vehicles. At least, thats how it is in CA. Anyhow, it sounds like he either needs to ditch that bike or get real handy with a wrench.

Update: Lemon Law in Illinois only applies to new cars - and specifically states that motorcycles are not apart of the lemon law. His bike is at the shop, and will be half price repair IF they look at it by Friday.

- Small towns screw you over in the end.

Man that is ridiculous. If I were your friend I would make it my personal mission to let everyone in the local motorcycle community know about this sorry shop.

You may wnat to tell your friend that HD is a publicly traded company on NASDAQ, and have him involve HD corporate offices as a shareholder. Inform them of the "experience", etc. and ask for assistance. Harley sells a brand as much (if not more so) than the motorcycles, which have become incidental to maintaining their image and trust -- it is, after all, what he paid extra for and HD is keenly aware of this. He'll likely get some names from corporate, and the dealership will be obligated to respond to both the shareholder and the execs. Dealerships don't want to do this because it affects their future options (and bottom line). And HD wants to know because in today's wired-in world it only takes one active blogger to temporarily cause a dip in share prices - something they definitely want to avoid. Try explaining in the morning roundup "...why did HD value drop $10 million overall lastnight because a shady dealership is ****ing with the customer base...and what are you doing to fix it?". Money still trumps bullshit.
