If you park your bike at a mall or at the gym and when you come back you see a guy seating on you bike what will you do or what is legal to do. Can you just grab him and throw him off???

I would admire the bike " Wow man that is a nice bike!" You know I have one just like it, as a matter of fact... now that I think of it, this is my bike.... so get your ass off it! Hopefully that's all it will take, but if it comes to me having to remove the him physically, then so be it.

Tell him when he starts making the payments on your bike- He can sit on it all he wants. Tell him to get the [email protected]##*@ Off!!

To me it is no different than someone sitting in my truck without my permission. The A$$ will be removed! I'll just tell whoever is with me to call 911 and get an ambulance coming for him.

I would take that as someone entering my property without permission. And shall be removed with and all means I can possibly use. He didnt ask to sit on my bike. Im not going to ask how he would like to be removed from it.

I think you have the right to do what ever you want if you think he is trying to steel it. At least I would think at the time I would have the right to do what I felt like doing no mater what it was. If he was that stupid to put himself at your mercy like that he would deserve what ever you gave him. I would at the very least yank him of and arm bar him smash his face into the ground and hold him for the cops and tell them you caught him on your bike trying to steel it. Lat them deal with it. You would be doing him a favor because the next guy may not be as nice. But that's me.

New York State Penal Law (YMMV)

§ 35.25 Justification; use of physical force to prevent or terminate larceny or criminal mischief.

A person may use physical force, other than deadly physical force, upon another person when and to the extent that he or she reasonably believes such to be necessary to prevent or terminate what he or she reasonably believes to be the commission or attempted commission by such other person of larceny or of criminal mischief with respect to property other than premises.

yeah, my natural inclination would be to level the guy but I'm too handsome for too much fighting

I'd just have to fill the situation out as sometimes things aren't always so cut and dry. Obviously if it was just a kid I'd handle it much differently than if it's a grown ass man. If the person doesn't appropriately respond to simple verbal commands to get off of my bike I will put my pistol in their face and see how well that persuades them.

I stoped at a little market this past winter to get a coffee in my pick up, from inside the store I used the remote start and went out the door. I hop in the dark grey silverado that was running just outside the door, when I went to put my key in the ignition there was already one in it and a guy with a pissed off what the **** are you doing look. I pointed at mine parked right beside it and said wrong truck. In the end matter resolved with no fighting and a good laugh.
